Birch Gold Group (“Birch Gold,” “we,” or “us”) respects your privacy. This Privacy Policy explains how we treat the information that we collect from you through our website, as well as over the phone ("Services"). It also explains your privacy rights and how you can exercise them.

We follow this privacy policy in accordance with the applicable law of the United States and those of its states in which we operate. We do not operate in countries other than the United States and we do not knowingly offer or provide our services to residents of countries other than those of the United States.

This privacy policy applies only to our collection of information; it does not apply to information that you may provide to or is collected by a third-party site or platform, including those that link to us or that we link to. Any information that is provided to or collected by a third-party site or platform is subject to that third-party’s privacy practices and policies, including any privacy rights that the third-party may offer.

Finally, this privacy policy does not apply to our collection of information from you should you apply to use our services or become a customer. Information collected from you as part of the application process or as a customer is subject to a separate privacy policy that will be provided to you as part of the application process.

2. How We Collect Your Personal Information

We collect information from you through our website and over the phone in order to provide you with more information about our services and to manage our relationship with you. You will voluntarily provide most of this information directly to us.

We use cookies, pixels, and tags on our website and certain marketing emails, which collect your IP address and certain other information from you when you visit our website, including when you visit our website via a link on another website. We also collect information using analytics tools, including when you visit our website.

3. The Types of Information We Collect

We collect the following types of information.

First, we collect personal information, which is information that identifies (whether directly or indirectly) a particular individual. Specifically, if you email us, request a free information kit through our website, or contact us by phone, we collect your first and last name, your email address, and your phone number. If you subscribe to one of our newsletters, we collect your email address only. We use this information to identify a user within our Services, to personalize the Services and share with you updates about our new products and services. We share this information with third-party service providers, analytics, advertising and marketing partners, our affiliates, and otherwise as might be required for legal or regulatory purposes. We do not collect any sensitive personal data as defined by the applicable laws and we do not draw interferences from your personal information to build your consumer profile.

Please know that we do not knowingly collect any information from anyone under 13 years of age. Our website, products and services are all directed to people who are at least 18 years old or older.

4. Use Of Your Personal Information

We do not sell, trade, or otherwise transfer your personal information to third-parties for their purposes. We may share your personal information with trusted third-parties who assist us in operating our website, conducting our business, or providing services to you on our behalf, such as sending you marketing emails. Otherwise, we may share your personal information to enforce our Terms of Use, to protect the rights, property, and safety of ourselves and others, to comply with legal process, or in other cases if we believe in good faith that disclosure is required by law. Third-Party Service Providers: We share information, including certain personal information, with our third-party service providers that we use to: process authentication and log-in information; provide hosting for and maintenance of our Services, e-mail marketing, solicit investors, scheduling meetings, backup, storage, payment processing, analytics and other services for us. 6. How We Store And Protect Your Personal Information

The security and confidentiality of your information are important to us. We will retain your personal information for the length of time needed to fulfill the purposes outlined in this privacy policy unless a longer retention period is required or permitted by law.

We limit access to your personal information to authorized Birch Gold employees and the categories third-parties identified above.

When you delete data or request that your data be deleted, we follow a deletion policy to make sure that your data is safely and completely removed from our servers or retained only in anonymized form. However, please note even after you have stopped using our Services, and regardless of any request to delete your data, we may continue to store your personal data if doing so is necessary for us to fulfil our legal obligations. We implement a range of technical, non-technical, and administrative measures that are designed to protect your information from unauthorized access, disclosure, use, and modification. We do not currently consider the ways we shared consumer personal information in the past 12 months to comprise the “sale” of personal information. However, use of online tracking technologies may be considered a “sale” / “sharing” under applicable law. Your request to opt out of “sale” / “sharing” will be linked to your browser identifier only. If we cannot delete all of your personal information, we will give you a reason why we cannot do so. - Right to Correct Inaccurate Personal Information - Taking into account the nature of the personal information and the purposes of the processing, this right provides an individual with the ability to seek to correct or update personal data that individual considers that we hold about that individual.

- Right to Limit Use of Sensitive Information - This right is limited to sensitive personal information used for the purpose of inferring characteristics about an individual. We do not collect sensitive personal information nor do we use sensitive personal information for the purpose of inferring characteristics about an individual, therefore we do not offer a path to exercise this right.

- Right of Non-Discrimination and Non-Retaliation - We will not discriminate against you because you made any of these requests.

- Shine the Light - California's “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Services that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We may deny certain requests, or fulfill a request only in part, based on our legal rights and obligations.

Your request must:

  • Provide sufficient information for us to reasonably verify that you are the person about whom we collected personal information or an authorized representative of such person; and

  • Describe your request with sufficient detail for us to properly understand, evaluate, and respond to it.

If you wish to submit a verifiable consumer request on behalf of another individual, we will also need sufficient information to verify that the individual is the person about whom we collected personal information and that you are authorized to submit the request on their behalf. For requests to know, access, correct or delete personal information, we may ask you to provide sufficient evidence to show that you have provided the authorized agent signed permission to act on your behalf, verified your own identity directly with us pursuant to the instructions set forth in this Privacy Policy, and directly confirmed with us that you provided the authorized agent permission to submit the request on your behalf.

Authorized Agent

You may designate an authorized agent to submit a request on your behalf to access or delete your personal information. To do so, you must: (1) provide that authorized agent written and signed permission to submit such request; and (2) verify your own identity directly with us. Please note, we may deny a request from an authorized agent that does not submit proof that they have been authorized by you to act on your behalf.

10. Response Timing and Format

We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact us at privacy@birchgold.com.

We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

11. Opt-Out and Opt-In Rights

Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize use of your personal information for targeted advertising. However, you may change your mind and opt back in at any time by clicking the link above.

We will only use personal information provided in an opt-out request to review and comply with the request.

Our Services Website and App may contain links to other sites that are not operate or owned by us. If you click on a third-party link, you will be directed to that third-party’s site. We strongly advise you to review the Privacy Policy of every site you visit.

We have no control over, and assume no responsibility for the content, services, products, privacy policies or practices of any third-party sites, services or providers.

13. Information About Minors

We do not intentionally collect personal information from individuals who we have reason to believe are under the age of 13. If we learn that we collected any personal information of children under the age of 13 we will immediately delete such information and the corresponding account.
